1. Agreement to these terms
These Terms of Service ("Terms") form a binding agreement between you and PTX ("PTX", "we", "us", or "our") governing access to and use of the PTX website, application, and related services (the "Service").
By creating an account, starting a trial, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. The Service
PTX provides AI-powered virtual personal training features, which may include onboarding assessments, adaptive training programmes, workout logging, progress tracking, nutrition targets, and conversational coaching with virtual trainers.
Virtual trainers (including Jack, Maya, Max, and Theo) are artificial intelligence systems. They are not human personal trainers, clinicians, or emergency services. Outputs can be incomplete, incorrect, or unsuitable for your circumstances. You remain responsible for how you train and for seeking professional advice where appropriate.
3. Eligibility and accounts
- You must be at least 18 years old to use PTX
- You must provide accurate registration information and keep it up to date
- You are responsible for safeguarding your login credentials and for activity on your account
- One person may use one account unless we expressly agree otherwise in writing
Notify us promptly at support@ptx.app if you suspect unauthorised access to your account.
4. Health and safety disclaimer
PTX is a fitness technology service. It does not provide medical advice, diagnosis, or treatment, and it is not a substitute for care from a doctor, physiotherapist, or other qualified professional.
- Consult a healthcare professional before starting or changing an exercise programme, especially if you have injuries, illness, pregnancy, or other health concerns
- Stop training and seek medical help if you experience pain, dizziness, chest pain, or unusual symptoms
- Do not rely on PTX for emergency assistance, injury diagnosis, rehabilitation prescribing, or clinical decision-making
- You are solely responsible for confirming that exercises, loads, and schedules are appropriate for you
To the maximum extent permitted by law, you assume the risks associated with physical training undertaken while using the Service.
5. Subscriptions, trials, and billing
Paid access is offered on subscription plans (currently monthly and annual) with pricing shown on our Pricing page at the time of purchase. Prices are typically displayed in GBP and may include applicable taxes where required.
- New accounts may receive a 14-day free trial with access described at signup. Unless stated otherwise, a card is not required to start the trial
- After a trial ends, continued access requires an active paid subscription
- Subscriptions renew automatically at the then-current rate unless cancelled before renewal
- You can manage or cancel from account billing settings or via the payment provider customer portal
- Payments are processed by Stripe. Stripe's terms and privacy notices also apply to payment processing
If a payment fails, we may retry charging, notify you, and suspend access until payment is resolved. Except where required by applicable consumer law, fees are non-refundable once a billing period has started. If you believe a charge was made in error, contact support@ptx.app.
6. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose
- Misrepresent your age, identity, or health information in a way that undermines safe use
- Share, sell, or transfer your account, or allow others to use your credentials
- Attempt to reverse engineer, scrape, overload, probe, or disrupt the Service or its infrastructure
- Bypass usage limits, security controls, or payment requirements
- Use automated means to extract content except as allowed by ordinary browser use of the Service
- Upload malware or content that infringes others' rights
- Attempt to manipulate virtual trainers to produce abusive, dangerous, or disallowed guidance
We may investigate suspected violations and suspend or terminate access where reasonably necessary.
7. Your content and licence
You retain ownership of content you submit to the Service (such as profile details, workout logs, and chat messages). You grant PTX a worldwide, non-exclusive, royalty-free licence to host, process, adapt, and display that content solely as needed to operate, secure, personalise, and improve the Service.
You represent that you have the rights needed to submit that content and that doing so does not violate any law or third-party rights.
8. PTX intellectual property
The Service, including software, branding, trainer personas, programme templates, UI, documentation, and other materials, is owned by PTX or its licensors and protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you.
9. Third-party services
The Service depends on third-party providers (for example hosting, AI model providers, and Stripe). We are not responsible for third-party services we do not control, except to the extent required by law or expressly stated in these Terms.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided on an "as is" and "as available" basis. We do not warrant that the Service will be uninterrupted, error-free, or that coaching outputs will achieve any particular fitness result.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
11. Limitation of liability
To the fullest extent permitted by law, PTX and its officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, data, or goodwill; or training-related injuries arising from your use of the Service.
Subject to the non-excludable liabilities above, our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of (a) the amounts you paid to PTX for the Service in the 12 months before the claim, or (b) £100.
12. Suspension and termination
You may stop using the Service and cancel a subscription at any time through account settings or the billing portal. Cancellation takes effect at the end of the current paid period unless otherwise stated.
We may suspend or terminate access if you materially breach these Terms, if required for security or legal reasons, or if we discontinue the Service. Where reasonably practicable, we will provide notice.
13. Changes to the Service or Terms
We may update the Service and these Terms from time to time. For material changes to the Terms, we will update the "Last updated" date and provide additional notice where appropriate. If you continue using the Service after changes take effect, you agree to the revised Terms.
14. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-law rules. Courts in England and Wales have exclusive jurisdiction, except that if you are a consumer resident elsewhere you may also benefit from mandatory protections of your local law and courts.
